Justices weigh foreigners' suits vs. companies
WASHINGTON (AP) ? Corporations and human rights groups are squaring off in a Supreme Court fight over whether foreign victims of war crimes, killings and other atrocities can haul multinational companies into American courts and try to prove they were complicit in the abuses and should pay damages.
The rights groups say a 223-year-old law gives foreigners such as Nigerian-born Charles Wiwa the right to try to hold businesses accountable for the roles they play in atrocities. Energy and mining companies have been among the most frequent targets of these lawsuits in recent years following efforts by the military in Indonesia, Nigeria and elsewhere to clamp down on protests against oil and gas exploration and development.
The justices will hear arguments Tuesday over the reach of the Alien Tort Statute and a 20-year-old law that allows victims of torture to pursue civil lawsuits against the responsible individuals.
The Alien Tort Statute lay unused for most of American history until rights lawyers dusted it off beginning in the late 1970s. Lawsuits have been brought against individuals who allegedly took part in abuses and, more recently, against companies that do business in places where abuses occur and in the United States.
"The corporations have a lot of money and are very attractive targets," said Northwestern University law professor Eugene Kontorovich, an expert in international law. "The idea is that they were in bed with the countries."
But the federal appeals court in New York stopped a class-action suit against oil giant Royal Dutch Shell, saying the Alien Tort Statute does not allow suits against corporations.
Business interests argue that the legal tactic also will discourage investment in developing countries and they point out that they uniformly condemn human rights violations.
Wiwa, 44, fled Nigeria in 1996 following a crackdown on protests against Shell's oil operations in the Niger Delta. Wiwa and other natives of the oil-rich Ogoni region claim Shell was eager to stop protests in the area and was complicit in Nigerian government actions that included fatal shootings, rapes, beatings, arrests and property destruction.
He said an American court is the only place the Ogonis can seek accountability.
"Nigeria gets so much money from oil. There is no way the company will be held liable for anything in courts in Nigeria," Wiwa said. He now lives in Chicago, having been allowed into the United States as a political refugee.
In the most notorious incident of the crackdown, Nigeria's military dictatorship hanged author Ken Saro-Wiwa and eight other activists, sparking international outrage.
In 2009, Shell paid $15.5 million to settle a separate lawsuit filed in New York under the Alien Tort Statute and alleging that the oil giant was complicit in the executions of Saro-Wiwa and the others. The company did not admit it did anything wrong. Shell's Nigerian subsidiary ended its operations in the Ogoni region in 1993, although a pipeline still passes through the area.
Other cases pending in U.S. courts seek to hold accountable Chiquita Brands International for its relationship with paramilitary groups in Colombia; Exxon and Chevron for abuses in Indonesia and Nigeria, respectively; Britain-based mining concern Rio Tinto for allegedly aiding the Papua New Guinea government in a civil war; and several companies for their role in old racial apartheid system in South Africa.
Those companies, other than Chiquita, are among 15 multinational businesses that are supporting Shell in the Supreme Court.
In 2004, the high court warily endorsed some use of the Alien Tort Statute, saying the door "is still ajar subject to vigilant door keeping."
Another lurking issue has the potential to wipe out almost all lawsuits under the 1789 law. Rio Tinto has an appeal pending with the court that argues that the law never was intended to apply to conduct by a foreign government against its own citizens within its own borders. It is not clear whether the court will deal with that issue in the Nigeria case.
The federal government has warned about serious foreign policy concerns over the broad application of the Alien Tort Statute. Then-South African President Thabo Mbeki said a lower court ruling in the United States in the lawsuit concerning apartheid smacked of "judicial imperialism."
In this case, however, the Obama administration is on the side of the Ogonis.
In a second case being argued Tuesday, the justices will consider whether the Torture Victims Protection Act of 1992 can only be invoked against individuals, not organizations or corporations.
The sons and widow of Azzam Rahim have filed a civil lawsuit against the Palestinian Authority and the Palestine Liberation Organization. The Palestinian-born Rahim was a naturalized U.S. citizen who was beaten and died in the custody of Palestinian intelligence officers in Jericho in 1995. Three officers were jailed for their role in the case, according to a State Department report.
But when Rahim's relatives sought money damages for his death, the federal appeals court in Washington said they could not use the 1992 law to go after the Palestinian organizations. The law may be applied only to "natural persons," the appeals court said.
Some supporters of the lawsuits have drawn a link to the Supreme Court's 2010 ruling in the Citizens United case, which said corporations have the same rights as people to speak and spend freely to influence elections.
But if the court sides with businesses in these cases, it would be saying "corporations are not persons for the purpose of enforcing human rights violations. It's really a weird paradox," said Peter Weiss, vice president of the Center for Constitutional Rights and the first lawyer to win an appeals court ruling backing the use of the Alien Tort Statute to sue over human rights violations.

And if you?re in that middle class, then we?re going to make sure that you?ve got the tools to, even in a changing world, have some security and some stability in your life.
That?s what we?re fighting for.? That?s the choice in this election.
Actually, this is not a vision for America. This is a vision for the Soviet Union.
First of all, there is no basic promise in America that if you work hard you can do well. IN FACT, there is a basic promise in America that you can work hard and have everything go straight down the toilet.
Because that?s the nature of capitalism which, like it or not, is the economic system we have in America.

At that point, THE GOVERNMENT MUST BE FUNDING IT ALL, because no intelligent investor is.
And if people must take whatever you make, pretty soon, nobody is working hard. Except the government, which is appropriating for itself more and more private wealth and freedom in order to keep this bad show opening every night.?But eventually, the money runs out. Like it did in the Soviet Union.
And what kind of vision is this? Raise a family and put some money away for retirement. I thought the promise of America was that THE SKY?S THE LIMIT. Not some average life. In the Soviet Union, everyone raised a family, everyone had a home, everyone sent their kids to college, and everyone had a guaranteed retirement. Until they didn?t.
And Obama wants those already in the middle class merely aspire to ?some security and some stability.?
This is the very premise of socialism. You get a some security and some stability. And with the risk of failure removed, everyone settles into a placid existence propped up by the kindly hand of government.
Until the bottom drops out.

JUNEAU, Alaska (AP) ? Current and former aides to Sarah Palin lashed out Wednesday at HBO's "Game Change," describing the upcoming film's depictions of her on the 2008 campaign trail as "sick" and inaccurate.
None of the aides said they have yet seen the movie, which debuts March 10, and some said they had asked for an opportunity to screen the film but had been denied.
Trailers for the film, which is based on the bestselling book chronicling the 2008 presidential race, have been released, however, and some snippets appear to cast Palin in an unfavorable light. As portrayed by Julianne Moore, Palin is seen complaining about how she's being handled by political advisers and mumbling about missing her baby, who was born in April 2008. In one snippet, campaign strategist Steve Schmidt, portrayed by Woody Harrelson, describes her as being on the verge of a nervous breakdown.
Aides said none of that jibes with their own experiences with the former Alaska governor, and they defended her vigorously Wednesday.
Jason Recher, who handled vice presidential road operations for the McCain-Palin campaign, called Palin "one of the most engaged public servants I'd ever observed." Tom Van Flein, her former personal attorney, called her diligent, sharp and enthusiastic about the campaign.
Meg Stapleton, a former spokeswoman, said that she, unlike some of the others who worked with Palin during the campaign, had not been contacted by anyone associated with either the book or movie.
"They don't want to hear anything good," she said, her voice full of passion. "We all know Palin sells and the dramatization of Palin sells even more. This is sick."
"They mock Gov. Palin, you mock Gov. Palin, as weak and unable to cope and press forward," she told reporters on the conference call. "And the movie and the trailer ... say that. And yet look with your own eyes at what she and her family have endured and inspired over the last few years. Any lesser man would have hanged himself by now. So who's weak?"
Recher noted that Palin wasn't the primary focus of the book, and he said he told screenwriter and co-executive producer Danny Strong that the book "absolutely, unequivocally" did not accurately reflect his time with the McCain campaign.
Filmmakers have said that they sought historical accuracy.
Director Jay Roach last month said he wrote a long letter to Palin seeking an interview with her to help the film, "but I got a very quick email back from her attorney saying, 'I checked, she declined.'"
Strong, in an email, acknowledged that members of Palin's camp asked to screen the film but said filmmakers responded that they would privately screen the movie for Palin and her husband. He said Sarah Palin declined the offer.
The film portrays Palin "in a balanced light," he said, "showing her strengths and weaknesses as the vice presidential candidate."
In addition to the book, Strong said the movie is also based on 25 interviews conducted with members of the campaign by himself and Roach. He said secondary sources include Sarah Palin's book "Going Rogue," other books written on the campaign and "innumerable" newspaper and magazine articles.
Palin did not participate in Wednesday's call. Tim Crawford, the treasurer of the political action committee SarahPAC, who facilitated the call, said Palin is on the record as considering the movie a false narrative, and wrote about her experiences in one of her books.

Chinese company may take iPad core out of Apple

A Chinese company seeks to ban iPad exports from China, accusing Apple Inc. of violating its rights to the iPad name. This action enables local authorities to seize the gadgets.
?Proview Technology is petitioning Chinese Customs to block all import and exports of Apple iPads.
There have been media reports that authorities in several Chinese cities have already ordered retailers to stop selling iPads because of the dispute.
On Monday investigators in Shijiazhuang, southwest of Beijing, started seizing iPads at the request of a Chinese owner of the trademark.
The row comes as a blow to Apple which is preparing to unveil its third version of the iPad tablet in early March.
However big and important for Apple the Chinese market might be, practically all the company?s products are produced in China, making the multinational a hostage of legal proceedings in the country.
Proview Technology?s lawyers are seeking up to 10 billion yuan ($1.6 billion) as compensation for trademark infringement. They say Apple Inc is not directly in talks with Proview to settle the case.
Late last year Apple lost a case to Proview Technology in a Shijiazhuang court, which named Proview the owner of iPad trademark.
A court in Hong Kong, on the other hand, sided with Apple in a similar case.
Apple has appealed the decision of Shijiazhuang court and now awaits a final hearing in the Southern Guangdong High Court on February 29. The decision of this court is going to be final under the Chinese legal process.
In January 2012 Proview Technology filed a trademark violation complaint with the commercial bureau of Beijing.

?Proview Technology from Shijiazhuang registered the iPad trademark in China in 2001.
In 2009 Apple Inc obtained rights for the iPad trademark in 10 countries including one from a Taiwan?s Proview Taipei, a company affiliated with Proview Technology. It cost Apple $54,700.
Now the Chinese mainland company says it still has the right to use the name in China.
The options of Apple Inc. are currently limited to either conciliation with Proview Technology, or ? if the appeal to the higher court is lost?? facing devastating legal sanctions in China.
?Without a win in that Shenzhen case, all the other actions, whether it is administrative or with different courts, customs, Apple is not in a good position at all,? Stan Abrams, an intellectual property law professor at Beijing's Central University of Finance and Economics, told Reuters.

Prions point to a new style of evolution
THE rogue proteins behind variant CJD, the human form of mad cow disease, have revealed their benign side. Prions, it seems, lie at the heart of a newly discovered form of near-instant evolution that provides life with a third way to adapt to potentially lethal environments. Crucially, it involves neither genetic nor epigenetic changes to DNA.
The conventional view is that new traits can only evolve if DNA itself changes in some way. The classic way to do this is by mutating the genetic code itself. More recently, researchers have discovered that molecules can clamp onto DNA and prevent some parts of the sequence from being read, leading to genetic changes through a process that is known as epigenetics.
Yeast breaks the mould. In challenging conditions, it can instantly churn out hundreds of brand-new and potentially lifesaving proteins from its DNA, all without changing the genes in any way. Instead, yeast alters the way its DNA is read. The tiny fungi convert a special type of protein called Sup35 into a prion.
Sup35 normally plays an important role in the protein production line. It makes sure that the ribosomes within cells, in which the proteins are built, start and stop reading a DNA strand at just the right points to generate a certain protein.
When Sup35 transforms into a prion, it no longer performs that role. With this quality control missing, the entire gene sequence is read as it spools through the ribosome. This generates new proteins from sections of DNA that are usually ignored
The result is that the yeast generates a hotchpotch of brand-new proteins without changing its DNA in any way. Within that mix of new proteins could be some that are crucial for survival.
Susan Lindquist at the Whitehead Institute for Biomedical Research in Cambridge, Massachusetts, first saw this process, which she calls "combinatorial evolution", in 2004, while studying lab-grown Baker's yeast (Saccharomyces cerevisiae).
"We've been saying this is really cool and a way of producing new traits for years, but other people have said it's a disease of lab yeast," she says.
Now she's proved the sceptics wrong by demonstrating beyond doubt that the same process happens in nature too. She has seen it at work in 255 of 700 natural yeasts she and her colleagues have studied (Nature, DOI: 10.1038/nature10875).
Lindquist grew the yeast in a hostile environment - either oxygen-depleted or abnormally acidic, for example - and then exposed the survivors to a chemical that destroys prions. Many colonies withered, showing that the prions were responsible for their competitive edge.
What's more, the prions are passed down in mating, so daughter cells will also make the same suite of survivor proteins.
"First and foremost it's an adaptive strategy," says Lindquist. "It's a great way of acquiring new [physical traits]."
Lindquist says that it is even possible for the production of the new proteins to become "hard-wired" into the genome, through mutation in the genetic code, although she has yet to see this happen.
Other researchers are impressed. "It is truly amazing," says Yury Chernoff of the Georgia Institute of Technology in Atlanta, and one of the researchers who previously suspected that combinatorial evolution was a lab artefact.
"It means that 'protein mutations', or prions, have a strong impact on [the physical appearance of an organism], so not all evolution is occurring through a DNA change," Chernoff says.
Right now, it is unclear whether combinatorial evolution is a quirk of yeast biology or a more general fact of life, but researchers are hopeful that the latter is true.
"Prions could very well play an important role in natural evolution," speculates Rong Li at the Stowers Institute for Medical Research in Kansas City, Missouri, who recently found that yeast can also evolve by shuffling chromosomes.
